Do the vehicles need to meet any specific standards?

Yes, all vehicles used for services must meet strict standards to ensure safety, comfort, and quality for our clients. The following requirements must be met:

  1. Age Limit: Vehicles must not be older than 5 years. This ensures that all vehicles are modern, well-maintained, and equipped with the latest safety and comfort features. Vehicles older than 5 years may be considered outdated and may not meet the safety or aesthetic standards required by our clients.
  2. Vehicle Type Compatibility: The vehicle model must be suitable for the category of service requested. The following vehicle categories and models are considered acceptable:
    • Standard Sedan: Mercedes C-Class or similar
    • Executive Sedan: Mercedes E-Class or similar
    • Luxury Sedan: Mercedes S-Class or similar
    • Standard Van: Mercedes Vito Tourer or similar

  3. Condition and Maintenance: Vehicles must be in excellent condition both mechanically and cosmetically.   4. Cleanliness and Presentation: Vehicles must be clean, both inside and out. The interior should be free from any odors, stains, or damage, with seats, carpets, and surfaces regularly cleaned and maintained. The exterior should be free of visible dents, scratches, or rust.
  5. Safety Features: All vehicles must be equipped with essential safety features, including functioning seat belts for every passenger, airbags, ABS brakes, and properly functioning lights and indicators. Regular safety checks must be performed to ensure these features are in optimal working condition.
  6. Branding: For consistency and brand recognition, vehicles should display the Toptour logo or other relevant branding, as agreed upon. This helps ensure that passengers can easily identify the vehicle upon pick-up.

What are the main requirements for drivers?

To ensure the highest level of service and safety for our clients, all drivers must meet the following key requirements:

  1. Valid Driving License: Drivers must hold a valid and up-to-date driving license for the country in which they operate. International licenses may be required for foreign drivers.

How can I become a supplier for TOPTOUR PORTUGAL®?

To become a supplier, simply register in the supplier information section on our website. After registration, our supplier management team will contact you to complete a questionnaire with details about your company and to provide the necessary legal documents. This process ensures that all suppliers meet our standards and can deliver high-quality services to our clients.

How does trip planning work?

Most trips are booked in advance, so you can choose the ones that best fit your schedule. When a new request is available in your city, you will receive a notification via email. If you wish to accept the service, you can confirm it directly through the email notification.

Once the service is accepted, it will be placed on our platform for you to manage. At this stage, you will need to use the TOPTOUR app to receive all the details of the trip, including the passenger information, route, time, and any special requests. The app also allows you to track the journey in real time, ensuring everything runs smoothly from start to finish.

This system enables efficient communication and ensures you have all the necessary information to provide top-quality service, while allowing flexibility to choose trips based on your availability.

How are payments made?

Payments to our partners are made regularly via bank transfer at the end of each month. You will receive payment for all completed services within that month, with the exact amount based on the services rendered. To ensure transparency, you can easily track your earnings through your partner account on our platform.

Through the platform, you will have access to detailed reports, including:

  • A summary of all completed and upcoming bookings.
  • An overview of your payments for the current month.
  • A record of payments received over the last few months.
  • A clear breakdown of what is due to be paid in the upcoming cycle.

This allows you to stay up to date and informed about your financial transactions at any time.

Is there a Service Level Agreement (SLA) for this partnership?

Yes, as a rule, we make a written contract with our partners. Here is an example.


SERVICE LEVEL AGREEMENT (SLA) – TOPTOUR PORTUGAL®

Este Acordo de Nível de Serviço (SLA) entra em vigor a partir de [Data Efetiva] entre [Nome da Empresa] (“Parceiro”), com sede em [Endereço do Parceiro], e TOPTOUR PORTUGAL® (“Toptour”), com sede em [Endereço da Toptour]. Coletivamente, as partes serão referidas como “Partes” e individualmente como “Parte”.

Considerando que as Partes desejam estabelecer uma relação comercial para a prestação de serviços de transporte de alta qualidade e concordam com os termos definidos neste SLA.

  1. OBJETIVO DO ACORDO

1.1 Objetivo:

Este Acordo estabelece os termos e condições para a prestação de serviços de transporte pela [Nome da Empresa] para a Toptour, incluindo transfers, serviços de motorista e tours privados personalizados.

1.2 Uso Limitado de Informações Proprietárias:

Ambas as Partes concordam que quaisquer informações proprietárias trocadas durante a vigência deste Acordo serão usadas exclusivamente para o propósito descrito na Seção 1.1 e não para qualquer outro propósito, salvo autorização expressa da Parte Reveladora.

  1. ESCOPOS DOS SERVIÇOS

2.1 Tipos de Serviços Prestados:

O Parceiro concorda em fornecer os seguintes serviços:

  • Transfers: Transfers de aeroporto, transfers intermunicipais, transfers entre hotéis, etc.
  • Serviços de Motorista: Serviços de motorista por hora, disponíveis sob demanda.
  • Tours Personalizados: Tours privados personalizados, com ou sem guia.

2.2 Especificações Operacionais:

  • Padrões de Veículos:
    • Veículos com no máximo 5 anos de idade.
    • Veículos limpos e bem mantidos, com ar condicionado e equipamentos de segurança funcionais.
    • Veículos devem exibir o logotipo da Toptour em superfícies externas e internas.
  • Padrões de Motoristas:
    • Motoristas devem estar profissionalmente vestidos (terno e gravata).
    • Pelo menos [X] anos de experiência e carteira de motorista válida.
    • Comunicação fluente em [idiomas exigidos].

2.3 Horário de Operação:

Os serviços serão prestados entre [X] AM e [X] PM, sete dias por semana, salvo acordo em contrário por escrito.

  1. PADRÕES DE QUALIDADE E EXPECTATIVAS DE DESEMPENHO

3.1 Padrões de Entrega de Serviço:

  • Processo de Reserva: Todas as reservas devem ser confirmadas pela plataforma da Toptour e aceitas dentro de [X] horas.
  • Pontualidade: Os motoristas devem chegar ao local de coleta no máximo [X] minutos após o horário agendado.
  • Atendimento ao Cliente: O Parceiro concorda em manter uma avaliação de satisfação do cliente de no mínimo 90%. Avaliações inferiores a esse valor acionam um processo de revisão e possíveis ações corretivas.

3.2 Monitoramento e Avaliação:

  • Auditorias de Qualidade: A Toptour realizará auditorias aleatórias de qualidade de serviço, incluindo inspeções de veículos, avaliações de comportamento de motoristas e pesquisas de satisfação de clientes.
  • Não Conformidade: Caso o desempenho não atenda aos níveis aceitáveis, a Toptour se reserva o direito de solicitar ações corretivas ou rescindir o Acordo.
  1. COMUNICAÇÃO E GESTÃO DE RESERVAS

4.1 Processo de Reserva:

  • Solicitação de Serviços: A Toptour enviará solicitações de serviços ao Parceiro por meio de [e-mail, app, etc.]. Estas solicitações devem ser aceitas ou recusadas dentro de [X] horas.
  • Política de Cancelamento: O cancelamento deve ser comunicado com pelo menos [48] horas de antecedência do serviço agendado. Uma taxa de cancelamento de [X%] será aplicada se o cancelamento ocorrer após esse período.

4.2 Protocolo de Comunicação:

  • Contato Primário: Cada Parte designará um ponto de contato principal responsável por todas as comunicações relacionadas aos serviços, problemas e preocupações.
  • Tempo de Resposta: Toda comunicação entre as Partes deve ser respondida dentro de [X] horas durante os dias úteis.
  1. TERMOS DE PAGAMENTO E TAXAS

5.1 Preços:

O preço acordado para os serviços prestados será [X EUR] por [tipo de serviço], conforme listado no cronograma de preços anexo a este Acordo. Qualquer alteração no preço deve ser acordada por escrito entre as Partes.

5.2 Estrutura de Comissão:

  • O Parceiro deverá enviar faturas à Toptour ao final de cada semana, detalhando os serviços prestados.
  • Os pagamentos serão processados dentro de [X] dias após o recebimento da fatura.
  1. SEGURO E RESPONSABILIDADE

6.1 Exigências de Seguro:

O Parceiro deverá manter um seguro abrangente para todos os veículos usados para fornecer os serviços sob este Acordo, incluindo cobertura para responsabilidade civil, lesões aos passageiros e danos ao veículo.

6.2 Responsabilidade:

A Toptour não será responsabilizada por qualquer acidente ou dano ocorrido durante a prestação dos serviços pelo Parceiro. O Parceiro assumirá total responsabilidade por tais incidentes.

  1. CONFIDENCIALIDADE

7.1 Informações Confidenciais:

Ambas as Partes concordam em manter a confidencialidade de todas as informações proprietárias ou confidenciais compartilhadas durante a vigência deste Acordo.

7.2 Obrigações de Não Divulgação:

A Parte Receptora não divulgará Informações Confidenciais a terceiros sem o consentimento por escrito da Parte Reveladora, exceto conforme exigido por lei.

  1. CONFORMIDADE COM LEIS

8.1 Conformidade Legal:

O Parceiro concorda em cumprir todas as leis locais, estaduais e nacionais, incluindo, mas não se limitando, a leis de trânsito, exigências de seguro, regulamentos de saúde e segurança e leis ambientais.

8.2 Licenças e Permissões:

O Parceiro deverá garantir que todos os motoristas possuam carteiras de motorista válidas e que todos os veículos atendam aos requisitos regulatórios, incluindo as permissões necessárias para o transporte comercial.

  1. RESOLUÇÃO DE CONFLITOS E RESCISÃO

9.1 Resolução de Conflitos:

Quaisquer disputas decorrentes deste Acordo deverão ser resolvidas inicialmente por negociação. Se a resolução não for possível, a disputa será submetida a arbitragem vinculativa, conforme as leis de [jurisdição].

9.2 Rescisão:

  • Rescisão por Conveniência: Qualquer das Partes pode rescindir este Acordo com [X] dias de aviso por escrito, com efeito no final do prazo contratual.
  • Rescisão por Quebra de Contrato: Qualquer das Partes pode rescindir o Acordo imediatamente se a outra Parte violar materialmente os termos do Acordo e não corrigir a violação dentro de [X] dias após notificação.

10.1 Emendas:

Qualquer alteração a este Acordo deverá ser feita por escrito e assinada por ambas as Partes.

10.2 Divisibilidade:

Se qualquer disposição deste Acordo for considerada inexequível por um tribunal, as demais disposições continuarão em pleno vigor e efeito.

10.3 Força Maior:

Nenhuma das Partes será responsabilizada por atrasos ou falhas na execução de suas obrigações devido a eventos imprevistos ou circunstâncias além do controle das Partes, incluindo, mas não se limitando, a desastres naturais, greves ou ações governamentais.
